What is and is not covered by this Warranty?
Subject to the limitations and exclusions below, this Warranty applies only to valid Warranty claims on covered products as described herein (“Covered Products”) and only when such claims are made during the applicable Warranty period. The Warranty similarly only applies when the applicable Covered Product remains in the possession of the consumer who first purchased or a giftee who first received a new Covered Product directly from Audien or from an authorized reseller (collectively the “Original Purchaser”). If a giftee did not receive the Audien product directly from us, they will qualify as the “Original Purchaser” pursuant to this policy if the giftee was the first user who completes Audien’s online account registration for the Covered Product. For the avoidance of doubt, there can only be one person to whom this warranty applies. This Warranty is not transferable.
This Warranty applies only to non-commercial, in-home use of the Covered Products listed below, subject to the exclusions and limitations below. Any other use will void this Warranty. Proof of purchase is required as a condition to coverage under this Warranty. Regular maintenance (e.g., replacing domes, wax guards) is essential. Improper care may void your warranty.
What is covered?
If a manufacturing defect is confirmed upon inspection, we will repair your device or replace it with a new or refurbished unit of equivalent performance at no cost.
Audien Hearing Aids (the “Hearing Aids”) – Audien warrants that the Hearing Aids, including the internal electronic components, charging case, and any incorporated hardware elements, will be free from defects in materials and workmanship and will, under normal and intended use, function substantially in accordance with the product documentation and specifications for a period of 12 months from the date of original delivery.
Audien, either on its own or through an authorized third-party partner (“Authorized Repair Partner”), will cover the labor costs and, if required, replacement part costs to repair or replace the Covered Products pursuant to a valid Warranty claim. Any Covered Product that is replaced or repaired will be warranted for the remainder of the original applicable limited warranty period or 30 days from the date of replacement or repair, whichever is longer, or for any additional period required by applicable law.
Should you choose to have the Covered Product(s) repaired anywhere other than an Authorized Repair Partner, Audien shall not be responsible for damage done or additional repairs required based on use of unauthorized parts or repair methods. Audien may, at its sole discretion, fulfill any valid Warranty claim by providing a full refund of the price of purchase once the damaged or warranty item is returned to and received by Audien.
What Is Not Covered?
Any other Audien products or services, non-Audien products or services, labor, or products that are, or that Audien reasonably believes to be, stolen, counterfeit, or purchased from an unauthorized distributor or reseller, Covered Products purchased or used outside of the United States, or Covered Products that are missing or show signs of an altered serial number.
All software, even if sold or licensed with, or embedded in, the Covered Products.
Any Bluetooth or connectivity issues not caused by the Covered Products.
Products used for commercial, rental, or other for-profit services.
Defects, damage, or failure arising from
(i) normal wear and tear;
(ii) improper or negligent use, cleaning, or maintenance (including wax buildup or use outside intended environmental conditions);
(iii) repair other than as performed by an Authorized Repair Partner;
(iv) use or modification of the Covered Products with parts or accessories from third parties, or with parts or accessories not originally intended for or compatible with the Covered Products;
(v) any use contrary to or in breach of Audien’s Terms of Service or instructions;
(vi) accident, abuse, neglect, improper or abnormal use, corrosion, discoloration or cosmetic changes not affecting performance;
(vii) theft, vandalism, fire, flood, water damage, sweat damage, humidity, wind, lightning, freezing, or other natural disasters or acts of God;
(viii) exposure to water;
(ix) power surges, electrical failure, or charging damage not caused by a Covered Product.
Any attempt to modify the components of the Covered Products or modify, delete, add, or install software not provided by Audien.
Audien hearing aids are not waterproof and are not intended to be submerged in water. Submersion or exposure to water will void the Warranty.
Audien is not responsible or liable for indirect, special, incidental, or consequential damages, economic loss, loss of property or profits, loss of enjoyment or use, or other consequential damages in connection with the purchase, use, repair, or maintenance of Covered Products. Audien does not provide monetary or other compensation for any repairs, replacement parts, or transportation.
Audien does not warrant that the use or operation of the Covered Products will be uninterrupted or error-free.
Consumables, including domes, tips, wax guards, and batteries, are not covered by this Warranty.
Anything not expressly mentioned in the “What Is Covered” section above. To repair or replace items not covered under warranty, replacement fees will apply.
Where permitted by law and in an effort to reduce electronic waste, replacement units, parts and electronic components reconditioned to as-new condition by Audien or its vendors may sometimes be supplied as warranty replacement and constitute fulfillment of Warranty terms.
THIS LIMITED WARRANTY IS THE EXCLUSIVE WARRANTY GIVEN BY AUDIEN AND SUPERSEDES ANY PRIOR, CONTRARY, OR ADDITIONAL REPRESENTATIONS OR WARRANTIES. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY STATUTORY WARRANTY OR CONDITION OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED EXCEPT TO THE EXTENT PROHIBITED BY LAW. IN SUCH EVENT, THE WARRANTY IS LIMITED TO THE DURATION OF THE WARRANTY PERIODS SET FORTH ABOVE. THIS EXCLUSION APPLIES EVEN IF THIS LIMITED WARRANTY FAILS OF ITS ESSENTIAL PURPOSE AND REGARDLESS OF WHETHER DAMAGES ARE SOUGHT FOR BREACH OF WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY IN TORT, OR ANY OTHER LEGAL THEORY. SOME JURISDICTIONS DO NOT ALLOW FOR THE DISCLAIMER OF CERTAIN WARRANTIES, SO SOME OR ALL OF THE ABOVE DISCLAIMERS MAY NOT APPLY TO YOU. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS, WHICH VARY FROM STATE TO STATE.
How do I obtain warranty service and what costs may apply?
To be eligible for service under this Limited Warranty you must provide Audien with the serial number of your Covered Product (if applicable) and the dated receipt or other proof of purchase indicating the date purchased. Contact Customer Experience if you believe you need service support at AudienHearing.com/Support or support@audienhearing.com.
Claims must be made within the Warranty period.
If product is shipped to a customer service center, all related freight charges to and from the service center may be the customer’s responsibility unless prohibited by law.
If replacement parts are shipped while the product is under Warranty, the customer may be responsible for handling charges.
If approved, all returned hearing aids must be packaged to afford mechanical protection and proper electrostatic discharge protection, so damage does not occur while the product is in transit to Audien. Replacement packaging can be sent at additional cost.
If a successful claim is made for a Covered Product within the Warranty Period, any shipping costs to return the product to Audien will be at Audien’s cost (where required by law).
Before any warranty claim is initiated, all users agree to work in good faith with Audien’s customer service agents to troubleshoot problems.
